{"id":897,"date":"2012-10-04T14:02:41","date_gmt":"2012-10-04T14:02:41","guid":{"rendered":"https:\/\/thedurstfirm.com\/?p=897"},"modified":"2012-10-04T14:02:41","modified_gmt":"2012-10-04T14:02:41","slug":"unreported-income-and-divorce","status":"publish","type":"post","link":"https:\/\/thedurstfirm.com\/?p=897","title":{"rendered":"Unreported Income and Divorce"},"content":{"rendered":"<p>The issue of unreported income is one that client&#8217;s and attorneys are often forced to deal with during a divorce.\u00a0 Many\u00a0types of businesses\u00a0are supported by cash transactions.\u00a0It is important to recognize these situations so that they\u00a0can be\u00a0dealt with properly so as to avoid unnecessary consequences for the litigants. \u00a0 \u00a0At the outset, let me say that I do not advise that anyone fail to report or underreport their income. Signing your name to a tax return that you know, or believe, to be false can give rise to criminal and civil penalties. \u00a0The liability can even extend to a non-income producing spouse. \u00a0Securing &#8220;Innocent Spouse&#8221; relief under the IRS guidelines is difficult and one would be well advised to speak with an accountant if you believe you fall into this category.<\/p>\n<p>Documents filed with the cour such as a Case Information Statment and certifications must be true and accurate. \u00a0Documents to be offered as evidence such as tax returns and bank statments must similarly be \u00a0crdible. \u00a0Neither an attorney or a client can knowingly and willfully off misleading or incorrect documents for consideratiom. \u00a0If a judge becomes aware of unreported income they are bound to report the infraction to the IRS. \u00a0This obligation was established in the case of Sheridan v.
