{"id":1004,"date":"2013-02-12T20:59:53","date_gmt":"2013-02-13T01:59:53","guid":{"rendered":"https:\/\/thedurstfirm.com\/?p=1004"},"modified":"2013-02-12T21:00:14","modified_gmt":"2013-02-13T02:00:14","slug":"court-eases-burden-for-a-parent-seeking-to-relocate-out-of-nj-with-the-children","status":"publish","type":"post","link":"https:\/\/thedurstfirm.com\/?p=1004","title":{"rendered":"Court eases burden for a parent seeking to relocate out of NJ with the children"},"content":{"rendered":"<p>In today&#8217;s mobile society\u00a0 \u00a0in which both parents work it has become increasingly likely that the custodial parent may need t relocate outside of New Jersey.\u00a0\u00a0\u00a0 Generally, the custodial parent cannot move out of New Jersey without the consent of the other parent or a court order permitting the move.\u00a0 The case of Baures v. Lewis sets forth the criteria the court is to consider when deciding the issue.\u00a0 One of the factors is whether the moving parent can establish a good faith reason for the move.\u00a0 One good faith reason has been a new job.\u00a0 In a recently decided case it was held that actually having the new job is not required; simply identifying that the prospects for better employment exists can be sufficient.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>FAMILY LAW<\/strong><br \/>\n20-4-8952 <em>Benjamin v. (11 pp.) Having another job in place is not a prerequisite for a custodial parent wishing to relocate with a child to another state, but the likelihood of being able to establish a financially stable household is a relevant factor in considering a relocation application.
